Terms and Conditions
1. THE COMPANY - Any reference to "the company" throughout this document or in terms
and conditions refers to Tony Jones 17 Cleeves Close Warrington WA1 2JH.
2. THE CLIENT - Any reference to the "the client" throughout this document or in the
terms and conditions refers to the lead booking name and thier parties named overleaf
on the booking form.
3. BOOKING - The signing of the booking form constitutes acceptance of these terms
and conditions. Where the booking form is not signed, due perhaps to a late booking,
payment of all or part of the total sum due will constitute acceptance.
4. DEPOSIT AND PAYMENT OF BALANCE - Your completed booking form must be accompanied
by a non - refundable deposit of £100.00 per week. The full balance being required
not later than TEN weeks prior to departure.
5. LATE BOOKING - If booking within ten weeks of departure the total sum will be due
at the time of booking.
6. REFUNDABLE SECURITY DEPOSIT - a security deposit of £200.00 is required with the
full balance. After vacating, the property contents will be checked for damage and
general condition. The cost of any necessary repairs, together with the cost of
any exceptional cleaning or rubbish removal required will be deducted from said
deposit any balance due, shall be refunded within 14 days of the return date.
7. DAMAGE TO PROPERTY OR CONTENTS - The client shall remain responsible for any damage;
any costs of exceptional cleaning or rubbish removal without limitation. Should
the cost exceed the £200.00 security deposit the client will be required to meet
such costs as and when demanded.
8. CLEANING - the property will be cleaned prior to arrival and departure. It must
be left in an orderly condition with all kitchen utensils washed. Should the property
require extensive cleaning, the company or their agents reserve the right to withhold
any monies from the security deposit.
9. CHECK IN/OUT - The property is available from 16:00hrs on the day of arrival and
must be vacated by 10:00hrs on the day of departure. Changing of these times may
be possible if requested prior to departure from the UK.
10. CANCELLATION - If the client fails to pay the balance by the due date (weather
demanded or not), the company reserves the right to consider the booking cancelled.
In this event, or if the booking is cancelled by the client at any time prior to
the balance being paid, the company will take reasonable steps to replace the booking.
In the event that the vacancy cannot be filled on terms at least favourable as those
applicable to the original booking, the company shall charge the client full price.
The company strongly advises the client to arrange insurance to cover any unforeseen
change in circumstances. All cancellations and amendments MUST be notified in writing.
11. ALTERATIONS BY THE COMPANY - The company reserves the right to amend or cancel
the booking where necessitated by circumstances beyond his control. In such circumstances
the company will notify the client immediately the company becomes aware of said
necessity and will take all reasonable steps to replace the cancelled booking with
a property of similar or better standard as close to the original location/standard
as possible. In the event that this is not feasible, all monies paid by the client
will be refunded and neither the company nor the property owner shall be under any
further liability to the client.
12. AMENDMENT - If after requesting a booking, the client requests changes in the
nature of the accommodation, the arrival and departure dates, or any other aspect
of the booking, neither the company nor the property owner shall be under any obligation
to process such changes although wherever possible the company will do its utmost
to assist, in which case the client shall be responsible for any costs incurred
by the company or the property owner. The company reserves the right to treat any
amendment as a cancellation and invoke the provision of the cancellation condition.
13. TRAVEL DOCUMENTS - All passports, visas, travel and health certification etc.
are the responsibility of the client. British passports must be valid for a period
of SIX months after date of departure from the USA. YOU ARE STRONGLY RECCOMENDED
TO TAKE OUT HOLIDAY INSURANCE TO COVER DELAYED DEPARTURE, CANCELLATION ACCIDENT/ILLNESS
OR DAMAGES.
14. YOUR RESPONSIBILITIES - The properties are privately owned. Your party must treat
the property, contents and facilities with due respect. Any loss/damage must be
reported immediately to the Management Company. You must make good or pay for any
loss, damage or breakage. The company or their agents reserve the right to withhold
any monies from the security deposit for any loss or damage.
15. SAFETY - Children under the age of eighteen must be supervised by an adult in
the pool area. Glass and breakables MUST NOT be taken into the pool area.
16. FORCE MAJEURE - (matters beyond our reasonable control) The company shall not
be liable for any failure on the part of itself or any other party, to perform,
or delay in performing, where such failure or delay results from circumstances beyond
its reasonable control. Including (by way of example and without limitation) acts
of god, war, riot, government action, labour disputes, shortages in material and
delay of any goods, materials or services, weather conditions, airport regulations,
technical problems with transportation, closure of airports, temporary technical
breakdowns in accommodation.
17. COMPLAINTS - Must be made in writing to the managing agents in Florida within
24hrs of the problem arising. They will do their best to resolve any problem to
your satisfaction. On many estates there will be other homes and facilities under
construction. The company accepts no responsibility for complaints arising from
construction.
18. OTHER FACILITIES - Where the company is asked to arrange facilities and services
other than provision of the property itself, including but not restricted to; air
travel, car hire, travel insurance, we act in the arrangement of such facilities
purely as agents of the relevant travel or other agent providing said services and
these services will be subject to the terms and conditions relevant to the particular
agent concerned.
19. BOOKING CONFIRMATION - All bookings are accepted subject to availability of the
selected property at the time the booking and deposit are received by our office.
The booking will be confirmed to the client once it is confirmed with the property
owner and the managing agent in Florida.
20. GENERAL - If in any particular case any of these conditions shall be held to be
invalid or shall not apply to the contract the other conditions shall continue in
full force and effect.
21. LIMITATION OF LIABILITY - The aggregate liability of the company (weather in contract
or for negligence or breach of statutory or otherwise howsoever) to the client for
any loss or damage of whatever nature and howsoever caused shall be limited to and
in no circumstances shall exceed the price paid for the goods.
22. JURISDICTION - The contract arising from this booking is to be interpreted under
and is subject to the laws of England. By booking you agree to submit any dispute
or claim under it to the English law courts.
